REGISTRATION OF MARRIAGE FOR NON-MUSLIM APPLICANTS GENERAL INFORMATION

1. Registration of marriage is COMPULSORY for a non-muslim Malaysian.

2. Non-muslim foreigner living in Malaysia may apply to register their marriage under this act.

APPLICATION CONDITIONS

1. Applicants are required to be present at the National Registration Department (NRD) counter or Malaysian Representative Office abroad to submit the application for registration of marriage.

2. The place of application is dependent on the address stated in MyKad (for Malaysian) or the residential address in Malaysia (for non-citizen). This condition does not apply to the application for solemnisation and registration of marriages in churches, temples and associations.

3. The applicants must reside in the district of marriage for at least 7 days +1 day before applying for marriage at the relevant NRD office. This condition does not apply to the the application for solemnisation and registration of marriage in churches, temples and associations.

4. For marriage applications where one party or both parties are foreigner, applicants must submit the application to the NRD office. Marriage registration is only allowed at the NRD office.

5. The registration of marriage shall take place after 21 days + 1 day but not later than 6 months from the date of application. For marriage applications in a Malaysian Representative Office, the application will be sent to the NRD office of the marriage district in Malaysia where each party to the marriage was last ordinarily resident to be displayed for at least 21 days + 1 day.

6. Police / army personnel MUST get the Approval Letter to get married issuedd by the head of department concerned.

7. A licence as listed below, if applicable, have to be submitted with the application for marriage except for the application for a licence using Form JPN.KC01E is to be submitted after the application of marriage at NRD.

7.1. Application for marriage licence for parties whose relationships are prohibited is to be made using Form JPN.KC01A (subject to the approval of the Chief Minister or Menteri Besar). A fee of RM2.00 will be charged if approved.

7.2. Written consent to the marriage for one who has not completed 21 years of age but having completed 18 years is to be made using Form JPN.KC01B (requires permission of persons listed in paragraph 2, Form JPN.KC01B). No fee is charged.

7.3. Application for a marriage licence to dispense with the notice of marriage and certificate for marriage is to be made using Form JPN.KC01C (subject to the approval of the Chief Minister or Menteri Besar). A fee of RM100.00 will be charged if approved.

7.4. Application for a marriage licence for female below 18 years of age but having completed 16 years is to be made using Form JPN.KC01D (subject to the approval of the Chief Minister or Menteri Besar). A fee of RM10.00 will be charged if approved.

7.5. Application for a licence to solemnise marriage in a place other than the office of the Registrar is to be made using Form JPN.KC01E (subject to the approval of the Chief Minister or Menteri Besar). A fee of RM500.00 will be charged if approved.

7.6. The licences JPN.KC01C, JPN.01D and JPN.KC01E are valid for one month from the date of approval.

8. Student pass or temporary employment pass holder shall get an approval from the Immigration Department of Malaysia to register their marriage in Malaysia.

9. Non-citizen must produce a letter to confirm their marital status.

10. Myanmar citizen must produce a letter from their government to allow them to marry in Malaysia.

11. A confirmation letter from the respective government that the applicant is not a Muslim (i.e. Iran, Iraq, Egypt, Algeria, Pakistan, Bangladesh or other Muslim countries or from any other country if required).

12. Application for an authorisation letter for registration of marriage to a non-citizen at the NRD office in a different state shall be submitted to the Marriage and Divorce Division’s counter, NRD Headquarters, Putrajaya or by post addressed to:

13. It is the responsibility of the applicant to have available an interpreter during the registration of marriage if the applicant does not understand Malay Language or English.

14. Malaysian couples who wish to register customary or religious marriages in churches, temples or associations are required to go to any National Registration Department office to confirm the information on the marriage application and to pay a fee of RM20.00 for the Marriage Register.

REQUIRED DOCUMENTS

1. Form JPN.KC02 that is completed.

2. MyKad, MyPR or Malaysian green card (that is still valid).

3. ORIGINAL passport and photocopy of pages with personal details, the latest arrival date in Malaysia and a valid visa or pass for non-citizen.

4. One (1) colour passport-sized photograph per applicant.

5. Approval letter from the Immigration department for the student pass and temporary employment pass holders to register their marriage in Malaysia.

6. Approval letter to get marriage issued by the head of department for police / army personnel.

7. ORIGINAL and photocopy of the following documents with translation by a qualified translator into Malay Language or English if not originally in either language must be submitted, i.e:

7.1. Birth Certificate for non-citizen.

7.2. Decree nisi absolute (divorce certificate), if applicable.

7.3. Death certificate of previous spouse, if applicable.

7.4. Letter verifying marital status of a non-citizen applicant is to be:

7.4.1. certified by either the Malaysian representative in the applicant’s home country or the applicant's consulate in Malaysia, and

7.4.2. re-certified by the Ministry of Foreign Affairs (Wisma Putra) in Putrajaya, Kuching or Kota Kinabalu.

7.4.3. If the letter does not have a validity date, it will be deemed valid for 6 months from the date of issue.

7.5. Approval letter for a Myanmar citizen to marry in Malaysia from their government.

7.6. Confirmation letter that the applicant is not a Muslim from their government (i.e. Iran, Iraq, Egypt, Algeria, Pakistan, Bangladesh or other Muslim countries or from any other country if required).

8. Application for an authorisation letter for registration of marriage to a non-citizen at the NRD office in a different state shall be submitted at Marriage and Divorce Division’s counter, NRD Headquarters, Putrajaya or via post shall submit: 8.1. A cover letter stating the purpose, applicable via post.

8.2. ORIGINAL letter verifying marital status of a non-citizen applicant which had been:

8.2.1. certified by either the Malaysian representative in the applicant’s home country or the applicant's consulate in Malaysia, and

8.2.2. re-certified by the Ministry of Foreign Affairs (Wisma Putra) in Putrajaya, Kuching or Kota Kinabalu.

8.3. Approval letter from the Immigration Department of Malaysia for the student pass and temporary employment pass holders to register their marriage in Malaysia.

8.4. Photocopy of:

8.4.1. MyKad.

8.4.2. Passport’s pages with personal details, the latest arrival date in Malaysia and a valid visa or pass for non-citizen.

8.4.3. Birth Certificate for non citizen.

8.4.4. Decree nisi absolute (divorce certificate), if applicable.

8.4.5. Death certificate of previous spouse, if applicable.

8.5. Approval letter for Myanmar citizen to marry in Malaysia from their government.

8.6. Confirmation letter that the applicant is not a Muslim from the respective government (i.e. Iran, Iraq, Egypt, Algeria, Pakistan, Bangladesh or other Muslim countries or from any other country if required).

8.7. All the above documents must be translated into Malay Language or English by a qualified translator.

8.8. ORIGINAL documents must be produced when submitting the marriage application to the respective NRD office.

9. All documents, if applicable, must be translated into Malay Language or English by a qualified translator and submitted with the application.

10. Applicants who do not understand Malay Language will need to have the declaration in part D1 or D2 of the form JPN.KC02 translated by a qualified interpreter into the language that they understand.

PAYMENT:

1. RM10.00 for certificate for marriage.

2. RM20.00 for Marriage Certificate

The couple, together with 2 reliable witnessess aged 21 and above, MUST:

1. Bring along their ORIGINAL MyKADs/passports;

RE-REGISTRATION OF MARRIAGE FOR NON-MUSLIM COUPLES REGISTERED ACCORDING TO THE LAWS OF THE FOREIGN COUNTRY ON OR AFTER 01.03.1982

 
GENERAL INFORMATION
1. Application for re-registration of marriage for non-Muslims Malaysian whose marriage was registered under the laws of a foreign country. 
2. The re-registration does not apply to the non-citizen who was granted a Malaysian citizenship status after his or her marriage was registered under the laws of a foreign country.
 
APPLICATION CONDITIONS
1. The couple are required to be present at the NRD counter or Malaysian Representative Office overseas for the application and registration of marriage.
2. A marriage registered under the laws of a foreign country must be re-registered at the Malaysian Representative Office within 6 months of the date of marriage. If the couple enter Malaysia before the expired 6 months of the date where the marriage was registered under the laws of a foreign country then the calculation of 6 months will commence on the latest arrival date in Malaysia dictated in the passport. Re-registration after 6 months will incur a PENALTY. 
 
Attention: Section 35, Act 164:
“Any person who, being required by section 31 to appear before a Registrar, omits to do so within the prescribed time shall, on conviction, be liable to imprisonment for a term not exceeding one year or to a fine not exceeding one thousand ringgit or to both.”
 
REQUIRED DOCUMENTS 
1. Form JPN.KC06 that is completed
2. If the application submitted at:
2.1. Malaysian Representative Office overseas:
2.1.1. Malaysian passport for Malaysian, and
2.1.2. Identification document for foreign citizen. 
2.2.     NRD office:

2.2.2. ORIGINAL passport for Malaysian and foreigner including photocopy of the pages with personal details, latest arrival date in Malaysia, and dates of departure or arrival in the country where the marriage was registered.
3. One (1) colour passport-sized photograph per applicant.
4. ORIGINAL  and photocopy of the following documents with translation by a qualified translator into Malay Language or English if not originally in either language must be submitted, i.e:
4.1. Foreign marriage certificate.
4.2. Foreign marriage certificate from India, Thailand, Indonesia, Philippines, Nigeria, Sri Lanka or any other country if required, must be:
4.2.1. certified by either the Malaysian representative in their home country. or the applicant's consulate in Malaysia, and 
4.2.2. re-certified by the Ministry of Foreign Affairs (Wisma Putra) in Putrajaya, Kuching or Kota Kinabalu
4.3. Birth Certificate for non-citizen.
4.4. Decree nisi absolute (divorce certificate), if applicable.
4.5. Death certificate of previous spouse, if applicable.
4.6. A letter from the Myanmar government to confirm the validity of Myanmar’s marriage certificate.
4.7. Confirmation letter that the applicant is not a Muslim from the respective government  (i.e. Iran, Iraq, Egypt, Algeria, Pakistan, Bangladesh or other Muslim countries or from any other country if required).
5. All documents, if aplicable must be translated into Malay Language or English if not originally in either language by a qualified translator and submitted with the application.

PENALTY FOR LATE REGISTRATION
Registration made more than 6 months after the date of registration of marriage outside Malaysia is penalised:
1. RM100.00 for the first year.
2.   RM  50.00 for each subsequent year or part thereof.

APPLICATION FOR APPOINTMENT AS AN ASSISTANT REGISTRAR OF MARRIAGES 
 
GENERAL INFORMATION 
This application is for qualified committee members of churches, temples and communal associations to be appointed as Assistant Registrar of Marriages in their organisation to solemnise and register a marriage acoording to religion or custom at the premise stated in their appointed certificate.
APPLICATION CONDITIONS
1. The applicant is a committee member of a church, temple or communal association handling the customary affairs of the community who is supported by the organisation’s committee.
2. The applicant is voluntarily appointed and is deemed to be a public servant and subject to the Penal Code.
3. Applications shall be submitted to the NRD office in the respective district.
 
REQUIRED DOCUMENTS 
1. Form JPN.KC16 that is completed.
2. Three (3) recent passport-sized photographs of the applicant.
3. New application (photocopies of documents are required):
3.1. MyKad.
3.2. Certificate of registration of society (church or temple or association).
3.3. Proof of approval for change of name, address and constitution (if applicable).
3.4. The organisation’s constitution.
3.5. List of current committee members of the church or temple or association.
3.6. Current annual financial statement - for associations only.
3.7. Certificate displaying minimum academic qualification of MCE or SPM or SPMV.
3.8. Not older than 70 years old.
3.9. Not a commissioner for oaths.
3.10. The following photographs are to be affixed onto A4 paper:
3.10.1. Frontage of premises
3.10.2. Security features of the premises (windows and doors with grilles).
3.10.3. Locked steel cabinet to store controlled documents.
4. Application for extension (photocopies of documents are required):
4.1. Application for extension must be submitted to the NRD’s district office at least three months before the expiry date of the current appointment.
4.2. List of current committee members of the church or temple or association
4.3. Current annual financial statement - for associations only.
4.4. Proof of approval for change of name, address and constitution (if applicable).
4.5. Not older than 70 years old.
4.6. Not a commissioner for oaths.

- No charge.

Note: 
1. All photocopies of documents must be certified by the Registrar of Marriages and bear his signature, name, designation and official seal.
2. No charge or fee shall be imposed on the bridal couple for solemnisation and registration of marriage conducted voluntarily by the Assistant Registrar of Marriages.
3. Solemnisation and registration of marriage are not allowed outside of approved premises as stated in the appointed certificate.

SEARCH / EXTRACT OF MARRIAGE REGISTER
 
GENERAL INFORMATION
This is an application  to perform a search or an extract of the marriage register for persons who have registered their marriage. 
 
APPLICATION CONDITIONS
1. Applications can be submitted at any NRD counter or by post to any National Registration Department office.
2. Either spouse or their children or parents or siblings (brother or sister) or an appointed lawyer with an authorised letter may arrange for a search and extract of the marriage register. Third party which are not related to the marriage is NOT ALLOWED to apply for the search and extract of the marriage register.
3. Appointed lawyer must completed all informations required including the lawyer’s name, MyKad or ID number and affixed the lawyer’s official stamp in Part C of Form JPN.KC09. 
 
REQUIRED DOCUMENTS 
1. Form JPN.KC09 must be fully completed, particularly the ID number, names of spouses, date and place of marriage.
2. MyKad (photocopy only for applications by post).
3. ORIGINAL passport for non-citizen (photocopy of pages with personal details for applications at the counter or by post).
4. An additional document such as a bill for water, electricity or telephone, or other additional documentary proof (photocopy for applications by post).
5. The applicant must issue the power of attorney to delegate the lawyer or mother or father or sibling (brother or sister) to oversee the application, if applicable.
6. Application letter from the lawyer with power of attorney, if application is made through the lawyer.
 
PAYMENT
1. RM5.00 for each requested year of marriage search.
2. RM5.00 for extract of marriage register.
3. RM10.00 for extract of marriage register in English version.
4. RM4.00 for extract of marriage register under the Registration of Marriages Ordinance 1952.

  APPLICATION FOR REFERRAL TO MARRIAGE TRIBUNAL

 
GENERAL INFORMATION 
This application is intended to refer the matrimonial difficulties of non-Muslims to the marriage tribunal for reconciliation. 
 
APPLICATION CONDITION
The applicant is required to be present to submit the application for marriage tribunal at the NRD office for the area in which the couple last resided together.
 
REQUIRED DOCUMENTS 
1. Form JPN.KC14 that is completed.
2. Applicant’s MyKad.
3. ORIGINAL passport and photocopy of pages of personal details and latest arrival date in Malaysia for non-citizen.

CAVEAT  
 
GENERAL INFORMATION
Application by any person entering a caveat (objection) against a marriage application at the National Registration Department (NRD) or Malaysian Representative Office abroad. 
 
APPLICATION CONDITIONS
1. The applicant must be present at the NRD counter where the application of marriage is being displayed.
2. A caveat can be entered only against a marriage application that has not been issued a certificate for marriage by the marriage registrar.
3. Applicants should understand that a caveat cannot be made arbitrarily without strong evidence and reasonable grounds in accordance with the provisions of the law which states: 
Section 20(7), Act 164:
“If the High Court declares the grounds of objections to be frivolous and such as ought not to prevent the issue of the certificate for marriage the person entering the caveat shall be liable for the costs of all proceedings relating thereto and for damages to be recovered by suit or action by the party against whose marriage such caveat was entered.”

1. Application for re-registration of marriage of non-Muslims who married according to any law, religion, custom or usage before 01.03.1982. 
2. The re-registration does not apply to the foreign citizen who was granted a Malaysian citizenship status after their marriage according to any law, religion, custom or usage in the foreign country.
 
APPLICATION CONDITIONS
The couple are required to be present at the NRD counter during the application and registration of marriage.
 
REQUIRED DOCUMENTS 
1. Form JPN.KC06 that is completed.
2. MyKad.
3. For marriages registered abroad, ORIGINAL passport for Malaysian and foreigner including photocopy of the pages with personal details, latest arrival date in Malaysia, and dates of departure or arrival in the country where the marriage was registered.
4. One (1) colour passport-sized photograph per applicant.
5. ORIGINAL Marriage certificate and photocopy (compulsory if married overseas).
6. ORIGINAL and photocopies of children’s birth certificates (if any).
7. Wedding invitation card (if any).
8. Photographs of wedding according to any law, religion, custom or usage (if any). 
9. All documents must be translated into Malay Language or English by a qualified translator and submitted with the application.
 
PAYMENT
RM20.00 for Marriage Certificate.

Note:
A marriage that is valid under law, religion, custom or usage before 01/03/1982 i.e. the date of enactment of the Law Reform (Marriage and Divorce) 1976 or Act 164, is deemed to have been registered. Therefore, registration of the couple's marriage is not compulsory. However, voluntary registration is encouraged for record and documentation purposes.

Application for re-registration of marriage of Muslim couples who married abroad according to Islamic law and of non-Christian Sabah or Sarawak natives and indigenous couples of Peninsular Malaysia who marry according to their customs. 
 
APPLICATION CONDITIONS
The couple are required to be present at the NRD counter for the application and registration of marriage. 
 
REQUIRED DOCUMENTS 
1. Form JPN.KC13 that is completed.
2. MyKad.
3. ORIGINAL passport and photocopy of page with personal details and latest arrival date in Malaysia for non-citizen.
4. ORIGINAL marriage certificate (Islamic law) issued in a foreign country with a re-registration certificate issued by the Islamic Religious Department and  photocopy (for Muslim couples). 
5. ORIGINAL customary marriage certificate issued by the Council for Native Customs and Traditions of Sarawak or Sabah Native Court or Department of Orang Asli Development.
6. ORIGINALS and photocopies of children’s Birth Certificates (if any)
7. All documents must be translated into Malay Language or English by a qualified translator and submitted with the application.

This is a submission to the Registrar-General for updating a personal marriage record regarding decree of divorce or annulment granted by high court.

Updates to the marriage records related to divorce or annulment can be done only at the counters of the National Registration Department headquarters in Putrajaya or by post addressed to:

NOTE:  
1. Applicants are advised to make photocopies of the decree nisi absolute (divorced certificate) for future personal use. 
2. Non-Muslims Malaysian who registered their marriage under the laws of a foreign country and re-registered with the Malaysian Government (NRD  or  Malaysian Representative Office) afterwards, was divorced in foreign country an order from a Malaysian High Court is required to endorse the divorced before it can be registered at NRD.

2. MyKad (photocopy of MyKad if application is by post).
3. Photocopy of passport pages with personal details of prospective spouse who is a non-citizen.
4. Application letter stating the purpose of the application.
5. Statutory declaration stating the applicant's current marital status. If the applicant is outside the country, then the declaration needs to be made before a Malaysian representative in that country.
6. The applicant must issue the power of attorney to delegate the lawyer or mother or father or sibling (brother or sister) to oversee the application, if applicable. 
7. Application letter from the lawyer with power of attorney, if application is made through the lawyer.
