Report Of Person Presumed Dead (Sarawak)

Section 9 of the Births and Deaths Registration Ordinance (Sarawak Cap. 10) clearly states that the registration of death of a person in Malaysia is allowed only on condition that the body is found. For persons that the High Court has classified as presumed to be dead, the court will issue an order declaring that the person is legally presumed dead.

 

The NRD will not register or issue a death certificate for a person presumed dead. However, it will update the NRD system with information of the person that the High Court has declared to be presumed dead. For matters relating to a person who has been presumed dead, the next of kin must use the court order issued by the High Court.

 

Application to update the information of persons who are presumed dead by court order will be handled only by the NRD headquarters in Putrajaya. The application may also be submitted at the NRD of a state capital to be forwarded to the NRD headquarters in Putrajaya.

Application for report of person presumed dead may be submitted by the following persons or entities:

  1. Parent of the person whose name appears in the court order;
  2. Spouse of the person whose name appears in the court order;
  3. Child or legally adopted child of the person whose name appears in the court order;
  4. Sibling of the person whose name appears in the court order;
  5. Law firm
  1. Form III that is completed;
  2. Court order from the High Court or Shariah High Court or Court of Appeals or Federal Court that the person is presumed dead (a court order for presumption of death from courts other than those stated will not be accepted);
  3. Application letter from the law firm (if the applicant is a law firm);
  4. Identity card or identification document of the applicant (original and copy);
  5. Identity card of the client (if the applicant is a law firm) (copy);
  6. Identity card of the deceased

Late Registration Of Death (Sarawak)

Application for late registration of death is required when registration is made after the seventh day of death in Sarawak.

An application for late registration of death may be submitted by the following persons:

  1. Mother of the deceased;
  2. Father of the deceased;
  3. Child of the deceased;
  4. Sibling of the deceased;
  5. Spouse of the deceased;
  6. Investigating police officer if there is no next of kin of the deceased
  1. Forms III and XI;
  2. Certification from a Sarawak community leader or village chief;
  3. Form VIII (Medical Certificate of the Cause of Death);
  4. Form IX (After Post-Mortem);
  5. Identity card or identification document of the informant (original and copy);
  6. Identification document of the deceased;
  7. Police report if the identity card or extract of death registry of the deceased is not submitted

Application To Correct Factual Errors [Section 27 (3)] In The Birth Certificate (Sarawak)

Application to correct any factual errors other than the name of a child provided during the registration of birth due to incorrect or unavailable information. The applicant must submit supporting documents proving the factual errors.

Application to correct factual errors may be submitted by the following persons:
  • Birth Certificate owner;
  • Parent;
  • Legal guardian

The applicant is required to go to any National Registration Department counter in Sarawak with the necessary documents.

  • Forms X and Form VII  that are completed;
  • Statutory declaration SA/81;
  • Family information form BMK-81;
  • Birth Certificate (original and copy);
  • Passport or insurance documentation or bank book if the child has a passport or insurance or bank account (original and copy);

  • Identity Card or identity documents of the parents or parent’s death certificate child (original and copy);
  • Authorisation letter from the parents for the guardian to submit the application;
  • Marriage certificate or divorce (originals and copies);
  • Letter of guardianship from the Department of Social Welfare (if application is submitted by the child’s guardian) (original and copy);
  • Other supporting documents such as the certificate or card confirming embracing of Islam of a parent, birth or death certificate of a parent and the letter of approval to change name from the Identity Card Division of NRD

Application to correct minor errors made by the NRD involving spelling which even if corrected will not change the facts in the Birth Certificate.

Application to correct information in Section 25(2) may be submitted by the following persons:
  • Parent;

    Application To Change Name [Section 11] In The Birth Certificate For Child Under 1 Year (Sarawak)

    Application to change the name of a child that is already registered must be made within one (1) year of the date of birth of the child.

    Correction Application Information section 11 shall be made by the following individuals:

    Extract Of Birth Certificate (Sarawak)

    Application by an eligible applicant to obtain a copy of the birth register by paying a prescribed fee. Extract of the Birth Certificate can be made only at the State NRD Office and Putrajaya NRD.

    Application fee is RM5.00. Government agencies are exempted from payment.

    Late Registration Of Birth (Sarawak)

    Late registration of birth refers to registration made more than 42 days after the date of birth of a child in Malaysia.

    ELIGIBILITY OF THE APPLICANT OR SPONSOR OR INFORMANT
    • Parent;
    • If the father is not available, then the mother or a sponsor with knowledge of the birth who is 10 years older than the child;
    • If the father is not available and the mother has died, the application may be made by two (2) sponsors with knowledge of the child, who are both aged 21 and above and are at least 15 years older than the child;
    • If the newborn is found exposed and its birth was not registered, then the application may be submitted by two (2) sponsors who are social welfare officers or persons given custody of the child in accordance with the Child Protection Act 1991

    Application for late registration of birth can be made throughout Sarawak by bringing along the necessary documents to any NRD office near the applicant’s place of residence.

    • Form X – birth registration search or extract form
    • Certification of birth from the head of longhouse/village head/capitan/headman (form SPK)
    • Confirmation of birth by midwife (form SPB)
    • Copy of identity card or death certificate (if the midwife is deceased) of the head of longhouse and midwife
    • Recent passport-sized photograph
    • Extract of school register or school certificate with endorsement from the head teacher or school principal if the child is schooling and aged seven (7) and above, or alternatively, certification from a headman or village chief or Member of Parliament or member of a State Legislative Assembly for the constituency where the child resides, that the child has never been schooled and is aged seven (7) and above.

    • Marriage certificates or divorce certificate (originals and copies);

    • Extract of school register or school certificate with endorsement from the headmaster or school principal if the child is schooling and aged seven (7) and above, or alternatively, certification from a headman or village chief or Member of Parliament or member of a State Legislative Assembly for the constituency where the child resides, that the child has never been schooled and is aged seven (7) and above.

    Delayed Registration Of Birth (Sarawak)

    Delayed registration of birth refers to registration that is made from the 15th to the 42nd day after the birth of a child.

    Application for registration of a child may be submitted by the following persons:

    Normal Registration Of Stillbirth (Sarawak)

    The application for normal registration of birth of a child born in Malaysia shall be made within 14 days of the date of birth. The informant must be the mother/father/relative/person who is acquainted with the birth. The application can be made in Peninsular Malaysia, which will be forwarded to Sarawak for the approval of the Regional Registrar. [Section 14(a) and (b), Births & Deaths Registration Ordinance 1951 (Sarawak Cap.10)]

    The applicant must complete Form I and Form X (Extract) and attach supporting documents.
