Report Of Person Presumed Dead (Peninsular)

Section 18 of the Births and Deaths Registration Act 1957 (Act 299) clearly states that the registration of death of a person in Malaysia is allowed only on condition that the body is found. For persons that the High Court has classified as presumed to be dead, the court will issue an order declaring that the person is legally presumed dead.

 

The NRD will not register or issue a death certificate for a person presumed dead. However, it will update in the NRD system information on the person that the High Court has declared to be presumed dead. For matters relating to a person who has been presumed dead, the next of kin must use the court order issued by the High Court.

 

Application to update the information on a person presumed dead by court order will be handled only by the NRD headquarters in Putrajaya which will then issue a notification letter to update the status of the person presumed dead. Application may also be submitted at the NRD of a state capital to be forwarded to the NRD headquarters in Putrajaya.

Application for report of person presumed dead may be submitted by the following persons or entities:

  1. Parent of the person whose name appears in the court order;
  2. Spouse of the person whose name appears in the court order;
  3. Child or legally adopted child of the person whose name appears in the court order;
  4. Sibling of the person whose name appears in the court order;
  5. Law firm
  1. Form JPN.LM02;
  2. Court order from the High Court or Shariah High Court
  3. Application letter from the law firm (if the applicant is a law firm);
  4. Identity card or identification document of the applicant (original and copy);
  5. Identity card of the client (if the applicant is a law firm) (copy);
  6. Identity card of the deceased

Application by an eligible applicant to obtain a copy of the death register by paying a prescribed fee. Application for extract of Death Certificate may be made at any NRD office in Peninsular Malaysia.

Application for extract of Death Certificate may be submitted by the following persons or entities:

  1. Parent of the deceased;
  2. Spouse of the deceased;
  3. Child or legally adopted child of the deceased;
  4. Sibling of the deceased;
  5. Law firm;
  6. Statutory body;
  7. Government agency

CATEGORY 1: PERSON IN CATEGORIES 1 TO 4

  1. Form JPN.LM13 that is completed;
  2. Identity card or identification document of the applicant (original and copy);
  3. Copy of Death Certificate (if any)
  4. marriage certificate (original and copied)

 

CATEGORY 2: PERSON IN CATEGORY 5

  1. Form JPN.LM13 that is completed;
  2. Official letter from a law firm requesting search or extract of the register;
  3. Letter of appointment from the client (applicant);
  4. Identity card or identification document of the client (applicant) (original and copy);
  5. Power of attorney to oversee the application (if applicable)

 

CATEGORY 3: PERSON IN CATEGORIES 6 AND 7

  1. Form JPN.LM13 that is completed;
  2. Official letter from a statutory body or government agency to apply for a search or extract of the register;
  3. Power of attorney to oversee the application (if applicable)

Application fee is RM5.00. Government agencies are exempted from payment.

ACTION OF DEATH VERIFICATION AGENCIES (HOSPITALS, POLICE OR KUALA LUMPUR CITY HALL)

  1. Receive information regarding a death from an informant;
  2. Verify and issue death registration / burial permit JPN.LM02 (Amendment 1/11) and hand the blue copy of the document to the informant;
  3. Submit the grey copy of death registration / burial permit JPN.LM02 (Amendment 1/11) to the nearest NRD within 7 working days and the NRD will record information in the I-NRD system. The informant or the next of kin of the deceased may then obtain the Death Certificate from the assigned NRD office.

DOCUMENTS TO BE PRODUCED BY INFORMANT OR NEXT OF KIN OF THE DECEASED AT THE NRD OFFICE

  1. Copy of the blue death registration/burial permit JPN.LM02 (Amendment 1/11);
  2. Original identity card or identification document of the deceased;
  3. Identity card or identification document of the informant (original and copy);
  4. Certification by a medical practitioner of the cause of death [form JPN.LM09 or JPN.LM10 (Post-Mortem)] if death occurred in hospital

INDIVIDUALS ELIGIBLE TO COLLECT THE DEATH CERTIFICATE

  1. Parent of the deceased;
  2.  Spouse of the deceased;
  3. Child of the deceased;
  4. Sibling of the deceased;
  5. Informant of the death as recorded in the death registration/burial permit JPN.LM02 (Amendment 1/11)

ACTION OF NEXT OF KIN OF THE DECEASED OR INFORMANT

  1. Report the death to a death verification agency (hospital or police or Kuala Lumpur City Hall);
  2. Receive a blue copy of the death registration/burial permit JPN.LM02 (Amendment1/11) from the death verification agency;
  3. Submit a copy of JPN.LM02 (Amendment 1/11) to a cemetery caretaker for burial purposes; and
  4. Register at a nearby NRD and collect the death certificate.

DOCUMENTS TO BE PRODUCED BY NEXT OF KIN OF THE DECEASED AT THE NRD OFFICE

  1. Copy of the blue death registration/burial permit JPN.LM02 (Amendment1/11);
  2. Original identity card or identification document of the deceased;
  3. Identity card or identification document of the informant;

Application To Correct Factual Errors [Section 27 (3)] In The Birth Certificate (Peninsular)

Application to correct any factual errors provided during the registration of birth due to incorrect or unavailable information. The applicant must submit supporting documents proving the factual errors.

Application to correct factual errors may be submitted by the following persons:
  • Birth Certificate owner;
  • Parent;
  • Legal guardian
  • The applicant is required to go to any National Registration Department counter in Peninsular Malaysia with the necessary documents.

    Application For Re-Registration Of Legitimated Person (Section 17) (Peninsular)

    Application for re-registration of birth of a legitimated person is made when an illegitimate non-Muslim child is made legitimate by the High Court.

    Application for re-registration of a legitimated person may be submitted by the following person:

    Application to insert the name of a child aged more than 21 years who was registered without a name at birth.

    Application to insert the name for a child over age 21 may be submitted by the following persons:

    Registration Of Birth During The Hajj (Peninsular)

    The birth of a child during the Hajj pilgrimage must be reported to the registrar in Hejaz within 40 days of the date of birth or at the counter of the NRD Headquarters within 6 months of the date of birth. However, approval will be given only by the Registrar-General of the NRD Headquarters.[Section 4 (1) (a) and (b), Act 152]

    The application to register the birth of a child in Hejaz can be made at any NRD office in Peninsular Malaysia by submitting the fully completed Form JPN.LMH1 together with supporting documents.
