Application for Registration of Adoption (De Facto) in Peninsular Malaysia

Akta Registration Adoption 1952 (Akta 253) (de facto) is di bawah biandg kuasa National Registration Department and hanya terpakai di Peninsular Malaysia sahaja. Akta ini berpurpose for menregisterkan adopted child de facto di mana seseorang child berada in jagaan, seandg dibesarkan, ditanggung and educated by seseorang or pasangan suami isteri jointly, as his/her child or their own child for period not less than two years that continuous before registration adoption dibuat. Adoption ini termaktub di bawah Akta 253 and terpakai for mereka that Muslim and bukan Islam.

Application Registration Adoption de facto perlu dikemukakan di Office NRD (Peninsular Malaysia sahaja) in daerah adoptive parents or adoptive mother (tunggal) or adoptive father (tunggal) and adopted child tersebut residing.

Kelayakan child

1. Belum pernah berkahwin.
2. Berumur below 18 years old and residing di Peninsular Malaysia.
3. Telah berada in jagaan and maintained serta educated by seseorang or pasangan suami isteri jointly, as his/her child or their own child for period not less than two years that continuous before registration adoption dibuat.
4. Child bertaraf citizen or non-citizen.
5. Child memiliki identification document (Birth Certificate/ Identity Card/ Pasport/ Permit Masuk for citizen asing/ and visa perlu cukup period two years).

Kelayakan applicant

1. Salah seorang adoptive parents (suami/isteri) or adoptive mother (tunggal) or adoptive father (tunggal) bertaraf Citizen or Permanent Resident;
2. Adoptive parents or adoptive mother (tunggal) or adoptive father (tunggal) aged 25 years and above and sekurang-kurangnya 18 tahun lebih tua from child;
3. Pasangan suami isteri memiliki Documents Marriage that sah;
4. Mendapat keizinan adoption from ibu and bapa kandung or ibu tunggal. Sekiranya ibu kandung aged bawah 18 tahun, surat keizinan adoption must ditandatangani bersama with salah seorang mother or father or adik beradik ibu kandung that telah aged 18 years and above;

*Sekiranya tiada keizinan ibu and bapa kandung or ibu tunggal perlu mendapatkan laporan sosial from Jabatan Kebajikan Masyarakat.

5. The application must be submitted di NRD (Peninsular Malaysia sahaja) in daerah ibu and adoptive father residing.

i. Form Application Registration Adoption – NRD.AA01;
ii. Birth Certificate child (Original and Copy);
iii. Copy pasport child (for child that dilahirkan di abroad)
iii. Statutory Declaration or Surat Keizinan Adoption (NRD.AA07) by ibu and bapa kandung or ibu tunggal.
iv. Statutory Declaration by adoptive parents / adoptive mother (tunggal) / adoptive father (tunggal).
v. Satu copy Identity Card or pasport ibu and bapa kandung or ibu tunggal to child seperti that tercatat pada Birth Certificate child;
vi. Identity Card or pasport and Visa adoptive parents (Original and Copy);
vii. Documents perkahwinan adoptive parents that sah (Original and Copy);
viii. Birth Certificate or identification document anak-biological child adoptive parents (if any);
ix. Photograph penuh child ukuran poskad;
x. Bukti residence adoptive parents or adoptive mother (tunggal) or adoptive father (tunggal) seperti electricity bill/ water bill /telephone bill /assessment tax and sebagainya;
xi. Copy Death Certificate biological mother or father child if biological mother or father meninggal dunia;
xii. Copy penyata gaji applicant (if any); and
xiii. Form 13 (Applicant perlu mendapatkan Form 12 terlebih dahulu dari mana-mana Office National Registration Department (Peninsular Malaysia sahaja) that nearby or dari Office Kebajikan Masyarakat in kawasan residing adoptive parents or adoptive mother (tunggal) or adoptive father (tunggal) before Form 13 dikeluarkan by Office Jabatan Kebajikan Masyarakat)

Proceedings

i. Semua application registration adoption akan interviewed through sesi prosiding before the Registrar. The parties required to be present are:

a) Adoptive parents or adoptive mother (tunggal) or adoptive father (tunggal)
b) Child
c) Ibu bapa kandung / penjaga child that sah (jika perlu)

A fee of RM30.00 must be made after application adoption is approved
