Application for Caveat While the Marriage Application Form Is Displayed

A caveat is a request to object to a marriage application at the National Registration Department office or at the Malaysian Representative Office Abroad before the marriage certificate is issued.

  1. Applicants are required to be present at the NRD counter or at the relevant Malaysian Representative Office abroad where the marriage application is being exhibited.
  2. A caveat can only be made if there is a marriage application received and before a Certificate For Marriage is issued by the Registrar of Marriages
  3. The caveat cannot be arbitrarily submitted without solid evidence and reasonable grounds consistent with the provisions of the law which states:
    Section 20(7), Act 164:
    “If the High Court establishes the reasons for the objection as superficial and as not supposed to prevent the issuance of a certificate for marriage then the person who submits the caveat is responsible for paying the costs of all trial measures in relation to it and the damages that will be claimed through lawsuits or actions by the party whose marriage the caveat is submitted to.”

    Section 39 (1)
    “ (1) Any person who enters into a caveat to oppose the issuance of a certificate for marriage by the Registrar and who makes a false representation in or in support of the caveat knowing or believing the representation to be false or absent the reason for believing it to be true is guilty of an offence and may, on conviction, be imprisoned for a term not exceeding three years or fined not exceeding three thousand ringgit or both.”
  4. A caveat application is not permitted for a marriage to be solemnized at the Assistant Registrar of Marriages.

  1. The Marriage Caveat Form (NRD.KC04) is completed.
  2. MyKad
  3. PassportORIGINAL as well as a copy of the pages containing personal information as well as the latest arrival date to Malaysia in the passport for foreign nationals.
  4. Other supporting documents as evidence of objection (if relevant).

RM20.00 for application fee.
