Re-Registration of Marriage for Non-Muslim Couples Married Under Any Law, Religion, Custom or Usage Before 01.03.1982 Under the Law Reform (Marriage and Divorce) Act 1976 [Act 164]
- Non-Muslim Malaysian who wish to voluntarily register a marriage where the marriage has previously been solemnised under law or religion or custom or custom before 01 March 1982 may be registered under section 33 of Act 164.
“Notwithstanding the provisions of section 4, parties to a marriage solemnized under a law, religion, custom or custom before a predetermined date may, if the marriage has not been registered, apply at any time to a registrar in the prescribed form for the marriage to be registered”.
- This re-registration applies to Malaysian Citizens only.
- This registration is voluntary and the spouse is required to be present at the NRD counter when the marriage registration application is submitted.
Completed Marriage Registration Form (NRD.KC06).
- ORIGINAL MyKad (Malaysian Citizen).
- Passport / MyPR / MyKAS (Foreign Citizen).
- Identity documents used for the purpose of marriage registration by foreign nationals where relevant.
- One (1) passport-sized color photograph per applicant (Blue or White background).
- Proof of Marriage as follows :
- Marriage certificate, if any (ORIGINAL and copy).
- Wedding photos according to law, custom, religion or custom are fully dated, if any.
- Birth Certificate of the child, if any.
- The complete Wedding Invitation Card is dated.
- Other relevant evidence, if any.
- Citizen / Non-Citizen:
- Absolute Nisi Decree/Divorce Certificate, if applicable (ORIGINALS and copies).
- Previous spouse’s Death Certificate / Register, if relevant (ORIGINALS and copies).
- Letter of confirmation that the applicant is not a Muslim from the National Government of Iran, Iraq, Egypt, Algeria, Pakistan, Syria, Uzbekistan, Kazakhstan, Bangladesh or any other Islamic State or any other country if required.If other than the above countries, NRD reserves the right to request any supporting documents before an application can be accepted.
- However, the NRD reserves the right to determine any considerations based on the situation as deemed necessary.
- FormNRD.KC06 needs to be completed.
- MyKad
- If the marriage is solemnized outside Malaysia, proof of documents and travel documents must be submitted, namely the ORIGINAL passports of Malaysian citizens and foreign citizens as well as photocopies of passports containing personal information, the latest arrival date to Malaysia, and information on the date of entry and exit from the country when the marriage was registered.
- One (1) passport-sized color photograph per applicant.
- ORIGINAL Marriage Registry and photocopy
- ORIGINAL Birth Register of children and photocopy (if any).
- Wedding invitation cards (if any).
- Wedding photos according to law, custom, religion or custom (if any)
- All documents, if relevant, need to be translated into Bahasa Malaysia or English by a certified translator and included with the application.
