Re-Registration of Overseas Marriage Under the Law Reform (Marriage and Divorce) Act 1976 [Act 164] for Non-Muslim Couples Registered Before or After 01.03.1982

1. Nationality: MALAYSIA who have registered a marriage under the laws of a foreign country Islamic law re-register a marriage under Section 31 and failure to do so legal action may be taken under Section 35, Act 164. Spouses are required to be present at the NRD counter or Malaysian Representative Office abroad within 6 months from the date the marriage is registered abroad.
   
   “If a person is required by section 31 to appear before a registrar and he/she is not present within the stipulated period, then he/she may on conviction be imprisoned for a term of not more than 1 year or fined not more than one thousand dollars or both”.
   
2. This re-registration applies to Malaysian Citizens or one of Malaysian Citizens only.
3. Applications for Marriage Re-Registration submitted after a period of 6 months will be subject to a PENALTY fee.

1. Completed Marriage Registration Form (NRD.KC06).
2. ORIGINAL MyKad (Malaysian Citizen).
3. Passport
   MALAYSIANS
        i) ORIGINAL passport and copy of page containing personal information as well as date of arrival and date of exit from the country where the marriage was registered.
       ii) Verification of Information Records/ Movement in and out of the country from the Malaysian Immigration Department is required if there is no information on movement in and out of the country or Malaysia.
   
   foreign national
        i) ORIGINAL passport and a copy of the page containing personal information as well as the latest date of arrival to Malaysia.
       ii) Confirmation of Information Records/ Movement in and out of the country from the Immigration Department if there is no information on movement in and out of the country or Malaysia.
   
4. Identity documents used for the purpose of marriage registration by foreign nationals where relevant.
5. One (1) passport-sized color photograph per applicant (Blue or White background).
6. Overseas marriage certificate (ORIGINAL and copy).
7. marriage-certCountry India, Thailand, Indonesia, Philippines, Nigeria, Sri Lanka, Vietnam, Cambodia, Laos, Myanmar or any other country as deemed necessary. The Marriage Certificate shall be certified by the Malaysian representative in the applicant’s country or the embassy of the applicant’s country in Malaysia, and re-certified by the Ministry of Foreign Affairs (KLN) in Wisma Putra, Putrajaya, Kuching or Kota Kinabalu.
8. marriage-certORIGINALReleased byGovernment of Vietnam must be certified by the Vietnamese Embassy in Malaysia and reaffirmed by the Ministry of Foreign Affairs (Wisma Putra) in Putrajaya, Kuching or Kota Kinabalu.
9. Birth certificate for foreign nationals (ORIGINAL and copy).
10. Citizen / Non-Citizen:
    – Absolute Nisi Decree/Divorce Certificate, if applicable (ORIGINALS and copies).
    – Previous spouse’s Death Certificate / Register, if relevant (ORIGINALS and copies).
11. Letter of confirmation that the applicant is not a Muslim from the National Government of Iran, Iraq, Egypt, Algeria, Pakistan, Syria, Uzbekistan, Kazakhstan, Bangladesh or any other Islamic State or any other country if required.If other than the above countries, NRD reserves the right to request any supporting documents before the application can be accepted.
12. All original documents that Bukan in Bahasa Malaysia or English needs to be translated by a certified translator. The translator must sign, stamp and other information if necessary.
13. For translations carried out by certified translators in Malaysia such as in the Malaysian Courts or the Malaysian Institute of Translation and Books (ITBM), the document does not need to be certified by the applicant’s National Representative Office in Malaysia and the Ministry of Foreign Affairs Malaysia (Wisma Putra) in Putrajaya / Kota Kinabalu / Kuching.NRD also reserves the right to request any verification required before an application can be accepted.
14. Translations made at the applicant’s embassy in Malaysia or a certified translator abroad must be certified by either the Malaysian Embassy in that country or the Embassy of the applicant’s country in Malaysia and re-certified by the Ministry of Foreign Affairs Malaysia (Wisma Putra) in Putrajaya / Kota Kinabalu / Kuching.
15. However, the NRD reserves the right to determine any considerations and decisions based on the situation as deemed necessary.

RM20.00

For late registration more than 6 months from the date of marriage registration outside Malaysia the penalties are:

1. RM100.00 for the first year.

2. RM50.00 for each following year or part thereof.
