Registration of Marriage in Malaysia for Non-Muslim Applicants Through Application for Licence or Consent to Marriage Under the Law Reform (Marriage and Divorce) Act 1976 [Act 164]

1. Registration of marriage under Act 164 is COMPULSORY for all Malaysian citizens who are not Muslims.
2. The license approval stated below must be obtained before the marriage registration application is submitted, namely:
   i) Marriage license for parties with prohibited kinship ties (NRD.KC01A).
   ii) Marriage license without requiring notice of marriage and certificate for marriage under subsection 21(1) (NRD.KC01C)

     iii) Licence under subsection 21(2) (NRD.KC01D).
   
   “The Chief Minister may, in his discretion, grant a license under this section to solemnize a marriage even if the woman who wants to marry is under 18 years old, but however cannot grant the license before the woman is 16 years old”.
   
3. Meanwhile, an application for a license to solemnize a marriage elsewhere from the Registrar’s Office (NRD.KC01E) must be submitted after the application for marriage registration is made at the NRD.
4. License under subsection 21(3) (NRD.KC01E).
   
   “The Chief Minister when satisfied, by statutory declaration or such other deem fit, that it is more appropriate that a marriage under the Section be solemnized somewhere other than at the office of a Registrar may issue a licence in the form prescribed for that purpose.”
   
5. For marriage applications that require marriage approval under subsection 12(1) (NRD.KC01B) must be obtained before the application for marriage registration is submitted.

1. The kinship of a thousand or a father is an obstacle that is the same as the kinship of a thousand and is immaterial whether a person has been born legitimate or illegitimate.
2. Subject to Section 11 (6) of Act 164:

“Notwithstanding the provisions of this Section, the Chief Minister may, in his discretion, grant a licence under this Section for a marriage to be solemnised if he is satisfied that there is no obstacle to the marriage under the Laws, Religion, Customs or Conventions applicable to the parties to the marriage, and, if the marriage is solemnised under the licence then the marriage shall be deemed to be valid”.

1. An application for marriage under Section 11, Act 164 (Prohibited fraternity) must be applied for approval by the Chief Minister under this licence.
2. However, a license application is not required for a Hindu who wants to marry his sister’s daughter (niece) or his mother’s brother or sister (uncle).
3.  Temporary worker visit pass holder (Temporary Employment), Visa of Wife or Husband to Malaysian Citizen (Visa Spouse) for previous marriages and Special Pass other than the purpose of the marriage is unacceptable.
4. Only complete and organized marriage applications will be accepted.

NRD.KC01A

1. Applicable to all persons within Malaysia and to all persons domiciled in Malaysia but residing outside Malaysia.
2. Based on Part II, Act 164 explains that marriages registered under this Act are monogamous in which no marriage ceremony can be performed if the person’s marriage is still valid and ongoing.
3. Application for registration of marriage under Subsection 21(1) between non-Muslim couples involves the following 3 categories:
   a) Spouse of a Malaysian citizen with a Malaysian citizen;
   b) Spouse of a Malaysian citizen with a non-Malaysian citizen; or
   c) Spouse is not a Malaysian citizen with a non-Malaysian citizen.

1. The foreign national applicant has been in Malaysia for a period of seven (7) consecutive days prior to submitting the application.
2. Applications may be submitted on the eighth (8th) day of being in Malaysia.
3. Applicants need to undergo an interview session on the day the application is made or on a different day.
4. The results of the application will be notified within seven (7) working days.
5. The interview session will be conducted separately for the female partner and the male partner.
6. The decision is subject to the approval of the Chief Minister/Menteri Besar /State Director.
7. Professionals and contracts (Non-Citizens) are not allowed to apply.
8. Only complete and organized marriage applications will be accepted.

3. Passport (Original and Copy of page containing personal information).

NRD KC01C License – RM100.00 (if passed)

One (1) Month from the date of approval.

1. Marriage License Application For Female Couples Aged 16 Years But Under 18 Years According to Section 10, Law Reform (Marriage And Divorce ) Act 1976 (Act 164).
   
   “Confirmation of Marriage If One of the Parties is Below the Minimum Age of Marriage.
   
   Any marriage purporting to be solemnised in Malaysia is void if on the marriage one of the parties is 18 years of age unless, in respect of a woman who has completed the age of 16, the solemnisation of the marriage has been permitted with a licence granted by the Chief Minister under subsection 21(2).”
   
2. Applicable to all persons within Malaysia and to all persons domiciled in Malaysia but residing outside Malaysia.
    
3. It cannot be applied to Muslims or to a person who is married under Islamic law and the marriage also cannot be solemnized or registered under this act if one of the parties to the marriage adheres to Islam.
    
4. This act is also monogamous in that no marriage ceremony can be performed if one’s marriage is still valid and ongoing.
    
5. Applications for marriage registration under Subsection 21(2) between non-Muslim couples involve the following 3 categories:
   a) Spouse of citizen with citizen
   b) Spouse of a citizen with a non-citizen; or
   c) Non-citizen spouse with non-citizen.
   
6. For girls who have completed 16 years of age and have not reached 18 years of age, the marriage ceremony requires a license from the Chief Minister or if delegated to the Registrar General / Assistant Registrar General or Registrar Superintendent.
   
7. Marriage applications for female couples who are 16 years old but under the age of 18 can only be accepted at the Putrajaya NRD Headquarters, NRD State Capital and NRD branches that carry out marriage transactions.

1. Female applicants only.
2. An application is submitted together with RM10.00 for the payment of the license application.
3. The License Application Form Under Subsection 21(2) (NRD.KC01D) has been completed.
4. Written Forms and Acknowledgements shall be completed and signed before the Registrar of Marriages.
5. The approval period for the NRD office delegated by the Chief Minister is within seven (7) working days from the date the completed application is received at the counter.
6. The NRD office that is not delegated by the Minister requires fourteen (14) working days from the date the completed application is received at counters such as Kedah , Kelantan, Terengganu and Pahang.
7. Only complete and organized marriage applications will be accepted.

1. Form NRD.KC01D.
2. MyKad (ORIGINAL and copy).
3. Valid passports and visas of foreign nationals (ORIGINALS and copies of pages containing personal information as well as the latest date of arrival in Malaysia).
4. Oath of permission to marry by the Mother / Father / Adoptive Mother/Adoptive Father/ Guardian.
5. Identity document of the person giving consent (Origin and Copy).
6. Health Report of expectant mother (if relevant).
7. Document of financial resources of male and female spouses:
   
   WORKING WITH EMPLOYER:
   Employer-authorized income slips/financial statements/bank statements/ ASB statements.
   
   Furniture Factory Workers
   Confirmation of Village Leader/Elder/ Clan Leader/ Carrier / Harvest.
   
   TIDAK BEKERJA:
   An oath declaring the source of income.

1. Ensure that all documents that are not in Bahasa Malaysia or English need to be translated by a certified translator.
2. If translated by :
   The applicant’s embassy in Malaysia shall also be stamped by the Ministry of Foreign Affairs/ Wisma Putra in Putrajaya / Kota Kinabalu / Kuching or;
   
   Certified translators abroad must be stamped by either the Malaysian Embassy in the country or the Embassy of the country in Malaysia and also certified by the Ministry of Foreign Affairs / Wisma Putra in Putrajaya / Kota Kinabalu / Kuching
   
3. Ensure that documents that have been translated are fully signed and stamped.

License Application Fee – RM10.00

One (1) Month from the date of approval

1. Applicable to all persons within Malaysia and to all persons domiciled in Malaysia but residing outside Malaysia.

4. Application for registration of marriage under Subsection 21(3) between non-Muslim couples involves the following 3 categories:
   a) Spouse of citizen with citizen
   b) Spouse of a citizen with a non-citizen; or
   c) Non-citizen spouse with non-citizen.

1. The applicant must be in the marriage district for seven (7) days before the application can be submitted.
2. The Application Form for a License to solemnize a Marriage Elsewhere from the Registrar’s Office (NRD.KC01E) must be completed and sent to the NRD office according to the location where the solemnization will be made.
3. Both spouses should be present at the office at the time of application and for a review of the appropriate dates.
4. Registration place that allowed for marriage solicitation are as follows:
   i) Home
   ii) Hotel
   iii) Multipurpose hall
   iv) Resorts
   v)  Restaurant
5. Registration place that no allowed for marriage solicitation are as follows:
   i) Places with high risk of accidents such as high-rise buildings, choppy beaches, sea, skydiving and other dangerous activities.
   ii) Hospitals that have a risk of infection with diseases such as leprosy, tuberculosis and other infectious diseases.
   iii) Houses of Worship that are not appointed by the NRD.
6. The permitted hours for marriage registration shall be between 8.00 am and 8.00 pm or such time as the Registrar considers appropriate.
7. The marriage ceremony must be made within two (2) hours while the Registrar is at the wedding location.
8. All written forms and declarations must be filled out and signed before the Registrar of Marriages.
9. Marriage applications under this license can only be accepted at the Putrajaya NRD Headquarters or the State Capital NRD.

1. Application Form for License to Solemnize Marriage Somewhere Other Than the Registrar’s Office (NRD.KC01E).
2. MyKad (ORIGINAL and copy).
3. Passport and Visa (valid) / MyKAS / MyPR for foreign nationals (ORIGINAL and copy).
   
   For Passport and Visa holders a copy of the cover letter containing personal information as well as the latest date of arrival in Malaysia is required).
4. NRD reserves the right to request any supporting documents from the applicant before the application can be accepted.
